Civil law

Inheritance, division of assets, foreign judgments, unmarried partnerships and disputes between individuals: comprehensive, strategic legal support in Portugal.

02What it is

Civil matters, with a method.

Civil law covers the moments when personal and family life has legal consequences: an estate to organise, property to divide, a foreign decision needing recognition or a dispute with another person.

In each case we start by understanding what is at stake, which documents exist and which route, in or out of court, best serves the goal. We support the client from first contact to the decision.

03Areas of work

What we handle in civil law.

The list is not exhaustive. Each case is assessed in the first conversation.

  • Old family photographs on a table

    Succession and inheritance

Support for those inheriting or organising an estate: understanding what it includes, who the heirs are and how to proceed.

  • Key in a door lock

    Division of assets

Division of assets in or out of court, depending on whether the parties agree or need to go to court.

  • Wax seal on documents

    Foreign judgments and unmarried partnerships

Review and recognition of foreign judgments and recognition of unmarried partnerships where the situation arose in another country.

  • Magnifying glass over papers and a map

    Civil liability and disputes

Situations where one person must make good harm caused to another, and other disputes between individuals.

04How we support you

Four areas, one file.

Loose sheets are organised by subject: each column brings together what is needed to proceed.

  1. Step 01/04

    Assessment

We establish what is at stake and who is involved.

  2. Step 02/04

    Documents

We gather and check the documents supporting the case.

  3. Step 03/04

    Strategy

We choose between agreement and court proceedings, and explain each route.

  4. Step 04/04

    Ongoing support

We follow the proceedings through to the decision and its implementation.

05Documents

Documents in general terms

The final list is tailored to you. Documents may vary depending on the case.

  1. 01Identity documents for those involved
  2. 02Certificates, where available, such as death, birth or marriage certificates
  3. 03Documents proving assets, contracts or damage
  4. 04Decisions or judgments, for decisions made in another country
  5. 05Translations and apostilles, where required

Documents may vary depending on the case.

06Frequently asked questions

Questions about civil law

General answers. Your case may have particularities that only an assessment with the lawyer can clarify.

01Does a foreign judgment automatically apply in Portugal?

Generally, a decision made in another country needs a specific review and recognition process to take effect in Portugal. We assess your case and explain what applies.

02Must assets be divided in court?

Not always. Where the parties agree, assets may be divided out of court; where they do not, court proceedings may be necessary. In the first conversation we assess the most suitable route.

03Can I deal with an inheritance from outside Portugal?

In many cases, yes: the case assessment and some preparation can take place online. What is possible depends on the estate and the documents.
